It\u2019s an enormous issue.\u201d<\/li>\n<li>Paul Mollica, partner at Meites, Mulder, Mollica &amp; Glink in Chicago, has another warning for heavy users of networking sites:\u00a0 \u201cWhen the OFCCP [Office of Federal Contract Compliance Programs] or plaintiffs\u2019 attorneys come along with a discovery request and want to see the trail for recruiting, these employers are going to come up short,\u201d he contends, because \u201cthe records are in a digital mist.\u201d<\/li>\n<\/ul>\n<p>And it\u2019s not over when the sourcing is done.\u00a0 In the selection phase, \u201cusing social networks to screen candidates generates additional legal risks,\u201d according to the article.\u00a0 Explains Mollica,\u201cthe risk is that visiting Facebook or MySpace pages or even Googling candidates may reveal information that no employer should have in a properly constructed application or interview.\u201d<\/p>\n<p>There are even more perils to be feared, such as the dangers of changing job descriptions and laying off people who were \u201chired into bad positions.\u201d \u00a0But if you want to be thoroughly warned, read the whole article.<\/p>\n<p>In the meantime, let\u2019s take a look at the blowback.\u00a0 Commenters are mixed in their responses\u2014but one of them (solubrious1) offers this heartfelt response:\u00a0 \u201cStop freaking out about pretend legal issues when the real issue is workforce design, the concept of \u2018permanent\u2019 work, and the decisions made by political and business leaders (many who also do not use Twitter and Facebook) to de-value Human Resources in the core mission and vision of their organization.\u201d<\/p>\n<p>Meanwhile, one of Workforce Management\u2019s featured blogs (Fistful of Talent) takes aim at the \u201cDiscriminatory Twist\u201d article and lets loose with a full-scale rant:\u00a0 <a href=\"http:\/\/www.fistfuloftalent.com\/2009\/09\/hey-employment-law-experts-youre-killing-my-profession.html\">Hey Employment Law &#8220;Experts&#8221;, You&#8217;re Killing My Profession . . .<\/a><\/p>\n<p>Worth reading, including the comments.\u00a0 Choice quote:\u00a0 \u201cOh, I forgot.\u00a0 You only care about promoting your little section of the world, which is risk management from a legal perspective.\u00a0 In the meantime, you scare, intimidate and generally freeze the average HR person from adopting tools that can help them do their jobs better . . . \u201c<\/p>\n<p>What\u2019s the relevance of all this for the corporate Careers site?\u00a0 I suspect that similar concerns come up in the context of using social media and blogs as part of employer branding and online recruiting.\u00a0 The problem is (for all concerned) that Genie has left the bottle, and won\u2019t be going back in.<\/p>\n<p>So the inevitable outcome is \u201ca period of adjustment.\u201d\u00a0 Those are never fun.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Workforce Management has come up with another surprising article.\u00a0 (The first one was discussed here recently in Cut on the Bias.)\u00a0 And this time, the fur is flying.
