{"id":2077,"date":"2008-10-10T06:43:22","date_gmt":"2008-10-10T05:43:22","guid":{"rendered":"http:\/\/www.corporate-eye.com\/?p=2077"},"modified":"2008-10-09T16:00:15","modified_gmt":"2008-10-09T15:00:15","slug":"trademark-violations-the-good-the-bad-and-the-ugly-from-apple","status":"publish","type":"post","link":"https:\/\/www.corporate-eye.com\/main\/trademark-violations-the-good-the-bad-and-the-ugly-from-apple\/","title":{"rendered":"Trademark Violations &#8211; The Good, the Bad, and the Ugly from Apple"},"content":{"rendered":"<p>Corporations have every right to protect their trademarks, including their brand trademarks such as product names, slogans and logos.\u00a0 However, it&#8217;s important not to assume a false power with those trademarks simply because your company is bigger than others.<\/p>\n<p>A perfect example is in the news this week.\u00a0 In a <a href=\"http:\/\/www.schoolvictoria.com\/files\/pdf\/vsbt_response_sept24_2008.pdf\" target=\"_blank\" rel=\"noopener\"><strong>cease and desist letter<\/strong><\/a>, <a href=\"http:\/\/www.theregister.co.uk\/2008\/10\/09\/apple_logo_battle\/\" target=\"_blank\" rel=\"noopener\"><strong>Apple threatened the Victoria School of Business and Technology<\/strong><\/a> with legal action if the school doesn&#8217;t stop using their own apple logo, which they\u00a0have been using without any problems since 2005.\u00a0 Below are the two logos side-by-side.\u00a0 What do you think?<!--more--><\/p>\n<p><img decoding=\"async\" class=\"alignnone size-medium wp-image-2078 lazyload\" data-src=\"https:\/\/www.corporate-eye.com\/main\/wp-content\/uploads\/2008\/10\/vsbt_logo.jpg\" alt=\"\" width=\"180\" height=\"187\" data-srcset=\"https:\/\/www.corporate-eye.com\/main\/wp-content\/uploads\/2008\/10\/vsbt_logo.jpg 180w, https:\/\/www.corporate-eye.com\/main\/wp-content\/uploads\/2008\/10\/vsbt_logo-150x155.jpg 150w\" data-sizes=\"(max-width: 180px) 100vw, 180px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 180px; --smush-placeholder-aspect-ratio: 180\/187;\" \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0<img decoding=\"async\" class=\"alignnone size-medium wp-image-2079 lazyload\" data-src=\"https:\/\/www.corporate-eye.com\/main\/wp-content\/uploads\/2008\/10\/apple_logo.jpg\" alt=\"\" width=\"150\" height=\"181\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 150px; --smush-placeholder-aspect-ratio: 150\/181;\" \/><\/p>\n<p>One could argue that the logos are similar and both businesses operate in technical markets (although one manufactures technical products and one educates people about technology), however, there are two main questions that come to mind in this trademark debate, and I put the onus on Apple who appears to be using their size to bully the little guy.<\/p>\n<ol>\n<li>Can Apple truly claim the\u00a0singular right to use an apple in its brand identity?<\/li>\n<li>Is the case of the Victoria School of Business and Technology apple logo worth the negative publicity that common David vs. Goliath battles such as this typically bring to the aggressor?<\/li>\n<\/ol>\n<p>What can we learn from this?\u00a0 First, select a logo and imagery to communicate your brand that are unique.\u00a0 Second, pick and choose your battles.\u00a0<\/p>\n<p>While it&#8217;s likely that there is someone in Apple&#8217;s legal or marketing departments who automatically generates and sends cease and desist letters, and it&#8217;s possible that Apple will drop the legal threats once the powers that be review the matter, the damage is already done.\u00a0 In short, don&#8217;t pick an apple or other common object for your logo.\u00a0 Is your brand common <em>or<\/em> unique?\u00a0 Use imagery that communicates your brand message and promise and distinguishes your business from others, and avoid these types of legal entanglements that teeter on a fine line between justified and Goliath-esque.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Corporations have every right to protect their trademarks, including their brand trademarks such as product names, slogans and logos.\u00a0 However, it&#8217;s important not to assume a false power with those trademarks simply because your company is bigger than others.
